What this policy covers

This Capital One Shopping Online Privacy Policy (“Policy”) describes Capital One Shopping’s online and mobile privacy practices and applies to anyone in any country where we offer services (the United States, Canada, Australia, and the United Kingdom) who visits our website (www.capitaloneshopping.com), uses our browser extensions or any of our mobile applications (collectively, our “Services”), or visits Capital One Shopping-branded social media sites or pages.

The term “Capital One Shopping” or “we” or “us” or “our” in this Policy means Wikibuy Holdings, LLC, with respect to users who access our Services in the United States, Capital One Shopping Canada, Inc., with respect to users who access our Services in Canada (other than residents of the province of Quebec, Canada, where our Services are not offered), Capital One Shopping Australia Pty Ltd, with respect to users who access our Services in Australia, and Capital One Shopping UK Limited, with respect to users who access our Services in the United Kingdom.

What this policy does not cover

This Policy does not apply to the websites, mobile applications, or online services of other Capital One affiliates or businesses. For example, if you visit or access your accounts from www.capitalone.com, please review www.capitalone.com/privacy to understand how your online information may be collected, used, and shared. This Policy also does not apply to third-party merchants or other websites that we may link to online. For U.S. customers, information that you provide to Capital One Shopping when you enroll in, use, or obtain a product or service from us to be used primarily for personal, family, or household purposes is also governed by a separate notice entitled Capital One Shopping Privacy Opt Out Notice. Collecting, Using, and Sharing Information

What information we collect

When you use our Services, we may collect “personal information,” which means any data that can be associated with you as an individual, either directly or indirectly. We collect different information depending on how you use the Services and how you interact with us. The personal information we collect via the Services includes:

  • Identity data, such as your name, whether you have an account, your billing address, mailing/shipping address, zip/postal code, email, and phone details
  • Login data, such as your account username and password
  • Preference data, including inferences or predictions made about your interests, preferences, or likely behavior from any information we collect about you (excluding Sensitive Information)
  • Browsing, product, and e-commerce data, which includes transaction data and information about how you use the Services (e.g., If you download and use our browser extensions, we may collect product pages viewed, pricing information, general location data such as city, state, or country, purchase history on various merchant websites and services, the price you paid for items, whether a purchase was made, online advertisements detected and blocked, and the coupons that you used including information regarding whether or not a coupon or coupon code is valid or effective. We may also collect information on coupons and other discounts that you found using our Services, even if you do not use such coupons, so that we may share this coupon and discount information with other users)
  • Technical data, such as the device you are using to access our Services, your unique device ID, your internet protocol (IP) address, browser type and version, time zone and general location, display settings, browser plug-in types and versions, operating system and platform and other technology on the devices you use to access the Services, data about how you use our website and how you interact with our website and mobile advertisements, data about your mobile device, and advertising identifiers (e.g., Apple’s IDFA or Google’s Advertising ID)
  • Cookies and similar technologies data, including those which allow our Services, including our browser extensions, to operate, cookies that allow us to perform important functions such as confirming the details of purchases you make and coupon codes that you use, cookies that allow us to collect information such as browser type, pages visited, preferences, and your relationship with us, and cookies that allow us to customize content and advertisements for products and services on our websites and Services
  • Social media data, including your social media preferences
  • Marketing and communications data, including any communications we may receive from you, responses to surveys or other requests for feedback, and your preferences in receiving notifications, marketing, and other communications from us

“Sensitive Information” is a special type of personal information and could include details about race or ethnicity, religious or philosophical beliefs, sexual orientation or practices, political opinions, trade union membership, information about your health, and genetic and biometric data. We ask that you not send or disclose any Sensitive Information on or through the Services or otherwise to us.

How we collect personal information

We collect personal information in a variety of contexts. For example, we may collect information from:

  • Direct interactions with you, including when you open an account, use the Services, use our website, browser extensions, or mobile application, respond to surveys, provide feedback, or communicate with us
  • Automated technologies or interactions, including personal information received as you interact with our website, browser extensions, or mobile applications. This personal information may be collected by using cookies, web beacons, and other similar technologies as well as by other technical methods. How and why we use personal information

We collect and use your personal information for different reasons depending on how you use the Services. Depending on your jurisdiction, these reasons include when you consent to it (learn more about how to revoke your consent in the section below titled, "Revoke Your Consent."; where it is necessary for us to perform the contract we are about to enter into or have entered into with you; where it is necessary for our legitimate business interests (or those of a third party) and your interests and fundamental rights do not override those interests; and where we need to comply with a legal or regulatory obligation.

We may collect and use personal information for:

  • Providing the Services and Managing Your Account. The information that we use will depend on the Services to which you have agreed. For example: to enable you to sign up for and use Capital One Shopping products or Services and verify that your email address(es) and shopping account(s) are active and valid; to service and manage your accounts; to provide customer service or support, to communicate with you, and to provide online tools and features. We will engage in these activities when we have a contractual need to do so and/or based on our legitimate interest in providing the agreed-upon services to our customers.
  • Personalizing and Improving the Services. To improve, personalize, and optimize your website browsing and mobile application experiences by examining which parts of our website you visit or which aspect of our mobile applications you find most useful, and to improve Capital One Shopping or develop new products, services, features, or functionality; to identify and repair errors; to understand and analyze the usage trends and preferences of our users. We will engage in these activities when we have a contractual need to do so and/or based on our legitimate interest in providing the agreed-upon services to our customers.
  • Advertising, Marketing, and Promotions. To send communications, including updates on promotions and events, relating to products and services offered by us and by third parties we work with; to provide customized advertisements, content, and information, including through automated means; to track your entries, submissions, status in any promotions or other activities on or through Capital One Shopping. We will engage in these activities when we have a contractual need to do so and/or based on our legitimate interest in providing the agreed-upon services to our customers.
  • Detecting and Preventing Fraud. To protect ourselves or others from fraudulent, abusive, or unlawful uses or activity; to protect the safety of our employees, customers or other third parties; to verify your identity and/or location; to allow access to your accounts; to allow us to verify eligibility for offers and experiences; to assist us in taking data security precautions and to engage in fraud prevention/detection. We will engage in these activities when we have a contractual need to do so and/or based on our legitimate interest in providing the agreed-upon services to our customers.
  • Conducting Analytics and Research. To conduct research and development on technology, products, or services; to monitor and analyze the effectiveness of Capital One Shopping and third-party marketing activities; to compile aggregated statistics to understand trends or to research the percentage of users accessing a specific website feature, including processing done with aggregated and de-identified information that does not allow us to reasonably identify you. We will engage in these activities when we have a contractual need to do so and/or based on our legitimate interest in providing the agreed-upon services to our customers.
  • Carrying Out Legal and Business Purposes. To comply with applicable laws; to respond to civil, criminal, or regulatory lawsuits, subpoenas, or investigations; to exercise our rights or defend against legal claims; to resolve complaints and disputes; to perform compliance activities, institutional risk control, and regulatory reporting; to conduct human resources activities; to consider or complete a transaction (including the purchase or sale of a business or part of business, a corporate reorganization, or the insuring or securitization of assets); to protect our assets and interests; to conduct investigations; to manage or settle any actual or potential loss in the case of a breach of agreement or contravention of the law. We may use automated tools to identify and detect abuse of the Services or any other violation of the Capital One Shopping Terms of Service, which may lead to the consequences described therein (including but not limited to termination of your account). You may exercise your rights as described under the section below titled, "Your Privacy Rights and Choices," consistent with applicable law. We will engage in these activities when we have a contractual need to do so and/or based on our legitimate interest in providing the agreed-upon services to our customers.

Who we share personal information with and why

At times, we share your personal information with trusted third parties for a number of reasons.

  • Disclosure to Partners and Service Providers – We may provide your personal information to trusted third parties to process it for us so that we may provide Services to you, based on our instructions and in compliance with this Policy and any other appropriate confidentiality and security measures. These third parties are contractually obligated to keep such information confidential and to use it only to provide the services we have asked them to perform. For example, we use service providers to deliver and improve our products and services, and to deliver advertisements and monitor activities on our own website and other websites (including behavioral advertising on third-party sites as discussed below). We also share your personal information with partner merchants, e-commerce websites, and related service providers in order to confirm that you have made an online purchase that is covered by our Services. Capital One Shopping does NOT sell your personal information to any third party for the third party’s own marketing purposes, as described in the Capital One Shopping Privacy Opt Out Notice.  
  • Disclosure to Our Affiliates – We may provide your personal information to Capital One affiliates for them to use in ways that are consistent with this Privacy Policy. For instance, we exchange lists of user email addresses with other Capital One affiliates located in the United States, Canada, and the UK. We do this to ensure you do not receive duplicative promotional or other email communications and to comply with anti-spam laws. We may also share aggregated and de-identified information with Capital One affiliates for analytical purposes.
  • Disclosure for Legal and Regulatory Purposes – We may disclose the information we collect, including personal information, to the extent permitted by applicable law: in response to subpoenas, authorized information requests, or other legal processes or if, in our good faith opinion such disclosure is required or permitted by law without a specific disclosure; at the request of governmental authorities conducting an investigation; to enforce our terms and conditions or other policies applicable to our Services; to manage or settle any actual or potential loss in the case of a breach of agreement or contravention of the law; to protect our assets and interests; to conduct investigations; and to protect the rights, property, life, health, security, and safety of Capital One Shopping, any of our affiliates, or any third party.
  • Disclosure Related to Business Asset Transfers – We may disclose the information we collect, including personal information, to any third party in connection with, or during confidential negotiations of, any proposed or actual merger, purchase, sale (including a liquidation, realization, foreclosure or repossession) or any other type of acquisition of all or any portion of Capital One Shopping’s or any of our affiliates’ assets, conveyance or transfer of all or a portion of our business to another company. In such event, the acquiring company would be contractually required to use your collected information in accordance with this Privacy Policy and applicable law or to provide prior notice to you of any new or materially changed practices.

International Transfers of Your Information

Your personal information may also be stored or processed in countries other than your home country, including (for example) the United States, where we store and process your personal information, and also in other countries where our service providers operate. This means that your personal information may be subject to law enforcement access under the laws of those countries.

As required by applicable law, we implement safeguards to protect your personal information when we transfer it outside your country of residence. For example, for transfers from within the UK to outside the UK, we ensure a similar degree of protection is afforded to it by ensuring that at least one of the following safeguards is implemented:

  • Adequacy Decisions: The UK recognizes the EEA member states, and certain other countries, as providing an adequate level of data protection according to UK standards (the full list is available here).
  • Adequate Measures: For transfers from the UK to countries not considered adequate by the UK government, we have put in place adequate measures as applicable, such as standard contractual clauses adopted by the relevant authority, to protect your personal data.

Social Media

We sometimes partner with companies that operate social media websites through which you may engage with Capital One Shopping. When you interact with us on social media websites, we may collect information such as your likes, interests, feedback, and preferences. We collect personal information from our social media partners if you choose to share such information with them and they, in turn, share information with us. We recommend that you never include sensitive personal, financial, or other confidential information such as your Social Security number, account number, phone number, mailing address, or email address when posting or commenting online. Any posts you make on our official social media pages – including posts that contain pictures, comments, suggestions, opinions, complaints or personal information – are subject to the terms of use and privacy policies of the companies that operate the websites on which they appear. How we safeguard personal information

At Capital One Shopping, we have an information security program that includes administrative, technical, and physical measures that are designed to protect information within our company. While we strive to protect information about you, no method of data transmission or storage is 100% secure, and we cannot ensure or warrant the security of such information.

Capital One Shopping maintains customer authentication procedures to protect your personal information and account from identity theft. These procedures are for your protection. If you suspect a website is pretending to be a Capital One Shopping website (also known as “spoofing”), do not enter personal information; instead, contact us at help@capitaloneshopping.com.

Retention

The personal information we collect will be retained for as long as reasonably necessary for the purposes for which it was collected as set out in this Privacy Policy and consistent with our retention policies, in accordance with applicable laws. When determining these retention policies, we take into account the length of time personal information is required to be retained to provide the services; satisfy legal and compliance obligations and for audit purposes; address any complaints regarding the services; and defend or bring potential legal claims.

Reviewing and Updating Your Account Information

Keeping your account information up-to-date is very important. You may review or update certain account information by logging into your account online. If self-service through your account does not solve your request, please contact us (learn more about how to contact us in the section below titled, "Contact Us").

Revoking Your Consent

In some cases we may request your consent for optional uses of your information, such as when we send you promotional emails. You can unsubscribe to our promotional emails at any time without impacting the service we provide to you or affecting the relationship we have with you. You may opt out of push notifications or in-app messages at any time by adjusting the permissions in your mobile device settings. You can also modify your consent to the collection of some types of your information by uninstalling the mobile application or browser extensions. You can also withdraw your consent entirely by deleting your account when you’re logged on, and then uninstalling the mobile application and browser extensions, which will prevent you from using the Services. We will honor rights related to your personal information to the extent these rights are provided to you under applicable data protection laws. We will honor those rights as soon as practicable, consistent with applicable laws. Depending on your jurisdiction, you may have the following rights:

Please note that if you opt out of receiving marketing related emails from us, we may still send you important administrative messages, from which you cannot opt out.   • Right to Object: If you feel processing of your personal information based on Legitimate Interest impacts your fundamental rights and freedoms, you can ask us to stop processing your personal information. In some cases, the only way to stop processing your personal information may be for us to delete your account. Alternatively, we may demonstrate that we have compelling legitimate grounds to process your information which override your rights and freedoms.
  • Right to Restrict Processing: In certain circumstances, you can ask us to suspend the processing of your personal information. In some cases, the only way to stop processing your personal information may be for us to delete your account.
  • Right to Withdraw Consent: Where we process your personal information on the basis of consent, you have the right to withdraw your consent at any time subject to contractual and legal restrictions.

Some mobile devices come with a non-permanent advertising identifier or ID which gives companies the ability to serve targeted ads to a specific mobile device. By turning off ad tracking or location tracking on your mobile device, you may still see the same number of ads as before, but they may be less relevant because they will not be based on your interests.

Advertising of Capital One Shopping on Third-Party Sites

Our third party partners are subject to their own privacy policies. We and our third-party providers may collect information about your activities on our Services and across different websites, mobile apps, and devices over time for behavioral advertising purposes. These providers may then show you Capital One Shopping ads, including across the internet and mobile apps, and other devices, based in part on the information they have collected or that we have shared with them.

Please note that your preferences will apply only to the specific browser or device from which you opt out. You will need to opt out separately on all of your browsers and devices. Our Services do not function differently in response to browser “Do Not Track” signals, but you may opt out of certain targeted advertising as described above.

Protecting Children’s Privacy

Our Services are not intended for, nor targeted toward, individuals under 18. We do not knowingly collect personal information from individuals under age 18.
